Edwin R. Hall pleaded not guilty to charges of capital murder, kidnapping, rape and aggravated sodomy in the death of Overland Park teen Kelsey Smith today in Johnson County Court. But Hall had already proclaimed his innocence to the Pitch. Here’s what Hall said on Monday, July 16, speaking by phone from the Johnson County Detention Center.

Hall: “I maintain my innocence. Doesn’t that sound like lawyerese? There’s just a lot of stuff that doesn’t seem to make sense to me about this case, but … [Hall trails off and sighs].

Pitch: “Did you know [Kelsey Smith] at all?”

Hall: “No. I didn’t. I just, I mean, I saw her in the store.”

Pitch: “So you were there.”

Hall: “Yeah, I was there. I mean, that’s not a denied fact. I turned myself in because I was there.”

Pitch: “I didn’t realize you turned yourself in.”

Hall: “Yeah, see, they don’t really let that out on the news.”

[Recording breaks in: “This call is subject to monitoring and recording.”]

Hall: “Technically, I mean, I was arrested, technically.”

Pitch: “But you made yourself available to be arrested?”

Hall: “No, it was, ah, I had, when I found out that they wanted to speak to me, I went and I sought legal counsel, and me and legal counsel had sat down and we had called the detectives, and we had said that, ‘Hey, look, he wants to come in and he wants to talk to you,’ but because of my lawyer’s schedule I couldn’t do it right away. We had scheduled a time at, like, 1:30 that day to go and meet with them, like, right after he got done with his court appearance. We were all going to go down to the police station and meet with them. Around 1 o’clock, they picked me up. I went back to my house to get my medication. So I’d already planned to come in. I was going to take my insulin and head down to the police station.”

Pitch: “You were going to take your what?”

Hall: “I’m a diabetic. I was going to take my medication and then go down to the police station. And then they picked me up.”

Pitch: “Gotcha.”

Hall: “So it’s actually on record that I’d made plans to turn myself in. I mean, I don’t know, I’d like to think that people who do these kinds of things don’t turn themselves in, and don’t, all sorts of other … [trails off].

Pitch: “It shows some good will toward helping the investigation. Do you regret that?”

Hall: “Do I regret turning myself in? I’m gonna say no comment on that one. [Laughs.] Obviously I’m sitting in this jail and it’s not pleasant and everyone thinks I’m some kind of a monster now, so, yeah, in that respect I do, but if I had to do it again, knowing what’s happening here now, I would still do the same thing.”

Pitch: “What were you doing at Target?”

Hall: “Idly just bumbling around. Like, really nothing, killing time. I was lookin for an anniversary present, er, not an anniversary present, but a graduation present for my wife. I don’t know, I shop kind of funny, I just let stuff kinda bounce out at me. I don’t think I even stopped and looked at almost anything. I think I looked at a picture frame, that was about it. Yeah, apparently I looked at this girl and that was enough.”

Pitch: “You drive a truck. That was the other thing, right?”

Hall: “And that was my truck, I left it there. There’s some coincidences. I left my truck at Target. The news got that part right.”

Pitch: “What did they get wrong?”

Hall: “A lot. A lot. You’ve probably – ”

[“This call is subject to monitoring and recording.”]

“-- to be honest with you.”

Pitch: “I didn’t catch that.”

Hall: “You’ve probably gotten more news coverage on this than I have. I get it from the people who I care about, the people who are there to support me. They come back and they say, ‘They’re saying all this stuff about you and it’s not true,’ you know? It’s all like media hype, bringing up my past and my childhood and stuff like that. Yeah, I’m actually really displeased because they have cut me off from all support. They’ve confined me in pretty much solitude. It’s not people in here. I’m not too worried about that. But my friends, my family, I can’t talk to anyone -- they’re all on my witness list. I can’t have contact with witnesses. There are over 1,200 people on my witness list. Some of them are on there once, twice, three times. My wife is the one exception. She’s on there, but the judge made an exception on that.”

Seems like everyone here and throughout KC should let the justice system work and not jump to conclusions before evidence is presented. More than likely they have DNA evidence or they surely wouldn't pursue the death penalty in this day and age but no one knows that yet. Note from the begining of the interview he wants sympathy. Sympathy cause he turned himself in and look what happened. Why'd he seek counsel before heading down to the cops? Then he mentions his insulin. How many people are diabetic that never mention it? Not this guy. Then we are supposed to feel bad he is isolated? Obviously he ain't as he got people telling him what's going on in the outside, and I bet it ain't just his wife. It's the usage of the word in this specific situation. When you are reportedly professing your innocence in a case where you have been accused of violently murdering and raping someone, you don't use violent words like kill. Um, you need to calm down a bit. I can't wait until the evidence they have against him (there's a lot of it, which you'd know if you actually were close to this case instead of an internet troll who gets into emotionally resonant topics to act contrary for attention). I am all for innocent until proven guilty, as is everyone else who is sworn to uphold the constitution, but you can see why other people think he's guilty. There's a lot of circumstantial evidence weighing against him. Also, though the legal standard isn't guilty beyond a reasonable doubt, a grand jury must at least find it fairly likely he's committed the crime to hold him for trial. They have. I think the public at least has the right to trust the grand jury and say it's likely this guy did it, don't you?

Exactly. I can't think of a highly publicized case in recent memory where there has been so much circumstantial evidence pointing to a person. That's why so many people think he's guilty. The fact that a grand jury agrees further solidifies public sentiment against him. And, like Jesse said, no one has come forward and given any explanation that shows the circumstantial evidence is pure coincidence. I mean, based solely on the fact that he left the store just before her, but his truck didn't exit the parking lot until hours later (and just minutes after her car was left at Macy's) is kind of hard to ignore.

Thanks to a friend that works for Johnson County, I was able to read the affadavit on the case. They do have physical evidence- fingerprints and dna that places him at the scene of the crime and in her vehicle. The affadavit also describes what the video tape inside of Target recorded and what it described does not fit his scenario of looking for a gift. His behavior suggests he was scoping the place out and not "shopping" like he said.

Johnson County District Attorney Phill Kline said today he will seek the death penalty against Edwin R. “Jack” Hall, who is accused of kidnapping and killing 18-year-old Kelsey Smith of Overland Park.

Hall, 26, of Olathe is charged with capital murder, rape, aggravated kidnapping and aggravated criminal sodomy.

Hall pleaded not guilty to those charges in court this afternoon.

A Johnson County grand jury Tuesday night issued an indictment against Hall. The indictment replaced earlier charges filed by Kline.

By taking the case through the 15-member grand jury, prosecutors avoided a preliminary hearing in the case, which had been scheduled for Aug. 15. Prosecutors would have had to present enough evidence in open court for a judge to decide whether there was probable cause to move to trial. Taking the matter to grand jurors, who by law meet in secret, bypasses the preliminary hearing phase.

Kline said Tuesday night that, by law, he had five days from the arraignment to decide whether to pursue the death penalty.

Kline said that going through the grand jury protected the family’s privacy because the case involved sensitive material.

“The media has played a crucial role in the investigative phase of this case, but now we are in a different process and we must ensure that we have a fair trial,” he said.

This is the website for poor Kara Kopetsky, she is a missing girl from Belton, Missouri. She hasn't been found yet but a guy who was seen with her in Kansas does look like Edwin Hall.

I have read all of the comments so far and am amazed that folks have already come to judge this situation.
This is a tragic event and to see some of the comments from both sides shows indifference to the families on either side. Our laws were created over a long period of time and are designed to protect not only the victim but the accused.
I believe it would be in the best interest for everyone to take a step back and let the justice system follow its course. There are two families that have had their lives completely changed because of this event. There will be 12 more people that will be called to look at the facts as they are presented and make a judgement to that outcome.
I believe our efforts would be best put to use in remembering both families as they travel through this ordeal. Our's should be to keep mindful of them and let the system work to resolve the issues.
Yes, everyone will have an opinion, unfortunately speaking it now is a "Rush to Justice." whether you are proclaiming his guilt or innocense.
Let us all take a step back and see a bigger picture hear in the tragedy that has occurred and honor those families by staying out of it.
By not voicing our opinion at this point may help us all look less stupid as things unfold.....

I'm curious to see what the state's evidence is on this. As an attorney, I'm sure they have DNA and fingerprint evidence at the scenes, otherwise they wouldn't have probable cause to hold him.
